The Indian Case

With 300 sunny days a year, India offers a perfect market for solar power. However, that market has been relatively untapped until recently, when a range of off-grid and microgrid solar technologies started reaching both urban and rural areas.

A different approach that provides solar power through microgrid technology is being used by Mera Gao Power, a firm in Uttar Pradesh, India’s most populous state. The microgrid system places solar panels on a roof, with electricity wires “running to a few dozens nearby homes, allowing each seven hours of light a day plus a phone charger.” The inclusion of a phone charger is important because while the majority of Indians own a cell phone, they often lack access to electricity to charge it. A cell phone is particularly valuable in that it can provide access to resources and economic ladders otherwise unreachable, but this is only possible if the phone is recharged routinely. As of January 2013, Mera Gao Power had set up microgrids in 155 villages, providing light and electricity for 3,600 households.

The environmental benefits of solar power in India are significant. Thousands of tons of carbon dioxide from the burning of kerosene and diesel fuel will no longer be generated. Daily life has improved for the recipients of solar power as well.

Brazilian Regulations
on Energy Credit

ANEEL’s RN 482/12 stablishes the rules for this “energy compensation” system (which we will be calling “energy credits” or “solar power incentive law). This is the resolution that allows you to “trade” your energy with the existing power grid.

There are several importan information over this compensation system (which will make a difference when you connect your photovoltaic solar power system, the solar power generator, onto the power grid. Below you will find a summary of the key points:

What is the top potency that may be installed?

The highest allowed potency to be installed and continue within the regulations is of 5,000kWp (app. 35,000 m2 of solar panels!)

What are the applied taxes to photovolatic solar power and its exemptions?

ICMS Tax

In 2015, Brazilian organ CONFAZ (National Financy Policy Counsil) through the regulation SINIEF 2, revoked the agreement which oriented grid injected energy taxes. Each state should decide whether or not to tax the grid injected solar power.

States which have exempted ICMS over solar power:

  • Pernambuco
  • Rio de Janeiro
  • Rio Grande do Norte

For the states that have not yet applied exemption to ICMS (those not listed above), ICMS tax will be charged over credits, thus reducing the quantity you accumulate.

Examples: At a state charging 18% ICMS for each 1kWh of energy you inject at the grid, a 0.82kWh credit will be generated. In other words, ICMS when applied over solar power at the states which have not yet complied to the Finance Ministry’s decision, reduces your energy credits.

PIS and COFINS taxes

Federal Government, through law n. 13,169, exempted PIS and COFINS taxes over solar power injected at the grid.

Credit Compensation due to Time of Usage

If you are a high consumer of electric energy, you probably pay the energy consumed according the “time of usage” (“peak hours’ fee” and “off-peak hours’ fee”). In other words, you pay more to if you consume more energy in peak hours.

If that is the case, “energy credits” are compensated according to a simple formula:
if you pay 5 times the energy consumed at peak hours, you will should generate 5 times more credit on off-peak hours.

Example:
Off peak fee: R$ 0,2 / kWh
Peak fee, five times higher = R$ 1 / kWh

In order to compensate 100kWh consumed during peak hours, you should generate 500kWh during off-peak hours.

Notice that: if you are a high energy consumer, we suggest you negotiate with your grid distributor to have the same tax fee regardless of the time or ask the Company which installs your photovoltaic system to calculate its size (potency) so it will not generate more energy than what you demand. This way, you will reduce your consumption and will not generate energy credits.

Whatever your consumer profile, the Company in charge of installing your photovoltaic energy system will know the best option for you.

About contracted demand

For high consumers of electric energy, such as industries (which does not apply to households and most businesses), ANEEL’s 482/12 resolution stablishes that the photovoltaic solar power system must not have a higher potency than the contracted demand. In case you are an industry with a 800kW demand, your solar power generator must not exceed 800kWp.

This is a current obstacle which hinders the development of Brazilian solar power Market that should be removed.

When does the solar power credits expire?

Surplus energy generated by the photovoltaic system, which is injected into the grid, will be “lent” to the power distributor, generating then an energy “credit” for you. This energy credit is valid for 60 months.

Transfering solar power credits

The amounts of surplus energy produced and injected into the grid, which are not compensated at its produced place, may be used to compensate the consumption at other places, since they are properly registered to this end, attended by the same power distributor and owned by the same holders (either for private individuals or legal entities).

The consumer should define the priority order for the consumer units taking part on the electric energy compensation system, being the first one that in which the generation system is installed.

Shared solar power generation - How it works

You may transfer exceeding credits among properties where the power bill is under the same or different Ids, as long as previously agreed. This way, you may transfer your credits to another property of yours or do it through a credit union or a consortium group of people or Companies as for building a bigger solar energy generator and sharing this production afterwars.

For doing so, all of those included in the consortium must be under the same power distributor.

Solar power generation in condominiums - How it works

You may generate solar power in condominiums and share it among the tenants. It may also be used for common areas or shared among the light bills of the tenants accordingly.

For buildings, it is essential to have enough cover area, easiness of access and enough sunshine throughout the day. It is ideal 200m2 of available area.
